Consultation on the Data Availability and Transparency (Consequential Amendments) Transitional Rules 2022
An Accredited Data Service Provider (ADSP) is an expert intermediary who can assist data custodians to prepare and share Australian Government data appropriately with accredited users. The specialist data services that an ADSP may provide under the DATA scheme are:
- de-identification data service service
- secure access data service service
- complex data integration service.
Accredited Integrating Authorities (AIAs) under Commonwealth administrative arrangements are currently providing these specialist data services. It is proposed that eligible AIAs become ADSPs under the Data Availability and Transparency Act 2022 for a transition period to support the operation of the DATA Scheme.
Schedule 3 to the Data Availability and Transparency (Consequential Amendments) Act 2022 enables the Minister for Finance to make a Rule prescribing an entity as a ‘transitional entity’. Any entity listed in the Rule as a transitional entity would be taken to be an ADSP under the Act. The Rule will be a legislative instrument that is subject to disallowance by the Commonwealth Parliament.
An Exposure Draft of the proposed Rule to be made by the Minister is open for public consultation from 12 August until 12 September 2022.
